Terms and conditions

Booking a private property is very different from booking a regular hotel room, please read the following conditions carefully.

All bookings are made with DEL PRADO CO LTD, Properties and/or an AUTHORIZED REPRESENTATIVE (collectively referred to as OWNER), acting as agents for the name of the owners, properties presented or via other platforms. Payment of any deposit for the reservation will be considered as a confirmation of acceptance according to the following general conditions.

Reservations will be made on a first come, first served basis and must meet the minimum number of nights required depending on the period of stay, unless otherwise stated in the availability confirmation. Upon receipt of a request for availability confirmation, the applicable villa rates and the amount of the required deposit will be communicated. reserves the right to refuse a reservation request without giving any reason.

Payment of any deposit for the reservation will be considered as confirmation of acceptance under the following terms and conditions.

PAYMENT DEADLINE
Before the booking is confirmed and a contract becomes binding, reserves the right to increase or decrease the agreed prices. No contract will exist, agreed and accepted between the client and the villa owner until the funds have been received.

In case of booking the villa less than 3 months in advance, a minimum deposit of 50% must be paid to confirm the reservation, unless otherwise stated in the villa's terms and conditions. This deposit is non-refundable.

If you book a villa more than 3 months in advance, a 25% deposit is required to confirm the booking. The additional 25% of the deposit will be required 1 month before your stay. Full payment must be made no later than 8 days before your arrival date or 20 days before your arrival (peak season periods i.e. Chinese New Year, Easter, Christmas and New Year, and any other periods notified at the time of confirmation).

The reservation will be considered cancelled if funds have not been received by , within five (5) business days from the reservation date and OWNER or the owner of the villa reserves the right to allocate the villa to another client, in which case this rental agreement will be terminated without notice.

Payment:
Payment can be made either by Cash OR international bank transfer, net of bank charges, or by using the online payment gateway (3% administration fee may apply). If payment is made by bank transfer, a scanned copy of the bank transfer or payment confirmation slip is required. For the avoidance of doubt, all bank and administrative charges are the responsibility of the customer.

In case the customer makes payment via a credit card link. The customer will authorise OWNER to charge the credit card as per the booking details/invoice/credit card link and the terms and conditions described above. This authorisation of payment for the goods/services described above. The customer certifies that I am an authorised user of this credit card. I will not dispute/charge the payment to my credit card company as long as the transaction matches the terms and conditions stated in this booking form/details.

If OWNER does not receive the balance by the due date, reserves the right to cancel the reservation and cancellation fees may apply as set out below.

CANCELLATION POLICY
Cancellation will take effect from the day of receipt of written confirmation (email acceptable), unless otherwise stated in the villa's terms and conditions.

Fees
The following cancellation policies will apply depending on when the cancellation notification is received in writing and the length of stay in the villa.
Any cancellation made by the Client and/or Guests is subject to the penalties below:

A) If the Client and/or Guests cancel the reservation more than 30 days before the arrival date, 50% will be lost, 8 days before the arrival of the tenant, the balance, i.e. 50%, is lost by the tenant.

B) If the client and/or guests cancel the reservation within 30 days or less prior to the arrival date, 50% of the rental is forfeited.

C) Christmas and New Year period, Chinese New Year, for any cancellation after payment of the deposit and/or balance, all payments are lost.

D) In case of no-show: 100% of the total rental amount will be lost.

The above cancellation fees also apply if the Client and/or Guests cancel the reservation for non- payment of the balance.

MODIFICATIONS
Once the booking is confirmed, a fee of USD 50, or equivalent in baht, will apply for refund and amendment of the booking when carrying over to an existing booking applicable to the same villa only. If the booking dates need to be amended or changed, this may be treated as a cancellation of the original booking and cancellation fees may apply. Any amendment to the original booking is subject to approval by IV. An early departure penalty will also be subject to negotiation with IV.
In the event that the price of the new amended booking period is lower than the original booking, the difference will not be refunded to the Renter. However, if the price of the amended booking period is higher than the original booking, the difference may be charged to the Renter. OWNER will do its best to accommodate any reasonable changes, but the Client should be aware that some changes may not be possible. In the event that OWNER cannot accommodate the villa booked by the Renter for any reason, including the sale of a property and force majeure, reserves the right to transfer the Renter to another villa of similar type and value. If the price of the alternative villa is lower than the original booking, the difference will be refunded to the Renter. However, if the price of the new amended booking period is higher than the original booking, the difference may be charged to the Renter.

However, for any reason beyond OWNER's control, which may prevent OWNER from providing the Guests with the reserved Villa, OWNER, reserves the right to cancel the reservation.
For example, but not limited to, if the properties are damaged or rendered unusable, OWNER, will relocate the guests to another property for the required period, but no guarantee is given that it will be able to do so. In the event that this is not possible, or if the guests do not wish to be relocated, OWNER, will cancel the booking and provide a full refund, less bank transfer fees, of the amount paid to OWNER, for the villa. OWNER will not be liable for any other liability or claim by the guest or client for any consequential or incidental damages, including travel costs, alternative accommodation or other expenses.

* EXCLUSIONS AND ADDITIONAL CHARGES

Rates do NOT include ELECTRICITY, RUNNING WATER (WILL BE INVOICED AT THE END OF THE STAY AT THE CURRENT KW H RATE, ALSO, baggage handling, gratuities, telephone, fax and telegram charges, car rental, food, soft drinks and/or alcoholic beverages, personal effects, travel expenses, other third parties and any excessive cleaning required initially (such as upholstery or carpet shampooing, etc.) or replacement of BROKEN items. Normal wear and tear is accepted.

The cost of cleaning and garden supplies, POOL MAINTENANCE as well as local taxes are included in the rental rates.

Only the cost of supplies plus 20% plus the grocery bill will be the responsibility of the Customer. Gratuities for maintenance staff are encouraged and normal, but are left entirely at the discretion of the Customer.

ARRIVAL/DEPARTURE TIMES
Usual check-in and check-out times are check-out 11am/check-in 3pm, unless otherwise stated in the Villa Terms and Conditions. Any early arrival or late departure will be subject to availability of the Villa at the time of arrival or departure. Additional charges may apply and will be advised at the time of booking.

Customers are responsible for providing correct arrival information (flight number) whenever an airport transfer is offered as part of the booking.

SECURITY DEPOSIT
The standard security deposit required for each property varies as stated in the property description. Guests can pay directly to the owner prior to arrival or to the owner's representative OWNER immediately upon arrival at the property. Access to the property may be refused if the security deposit is not paid in full. We accept the security deposit in any currency equivalent to the requested amount in USD EUR OR Baht equivalent. The security deposit will normally be refunded after inspection at the end of the rental period, after deducting any additional expenses incurred on behalf of the guest during their stay or the cost of replacement or repair for any loss or damage to the property.

DAMAGE OR LOSSES
A property is usually someone's home. Please treat the rented property accordingly and leave the property and all its contents in good order and in an acceptable state of cleanliness. Any damage or loss caused during the rental period, as well as any special cleaning requirements, will be the responsibility of the guest and may be charged to their account and deducted from their security deposit. In the event of excessive or unacceptable loss or damage at any time during the rental period, the OWNER or their representative may require the guest and their party, including visitors, to vacate the property immediately, without compensation or refund.

ACCESS
The Property and its facilities are at the disposal of the Client during the Rental Period. However, the OWNER, the OWNER's representative or other staff and contractors may need to access the Property from time to time (e.g. for the purposes of the house, garden, pool maintenance, utilities and services, or to provide additional services and obligations requested by the Client, etc.). The Client is required to provide reasonable access to the Property for these purposes.

Only the number of persons stated in the rental agreement at the time of booking may reside on the premises. The number of registered persons stated at the time of booking is the maximum number of persons permitted, including children, and must not exceed the maximum capacity stated in the property description or elsewhere, except in the case of infants (under two years of age), or unless specific permission is approved at the time of booking. If the owner or a representative of the owner
discovers that an additional number of persons are staying at the property, it is the responsibility of the owner or his representative to ask the additional person(s) to vacate the premises. Otherwise, each additional person will be charged at the published rate of $300 per night or the rate stipulated in the applicable villa.

MINIMUM STAY CONDITIONS
A minimum stay of 3 days is required most of the year, unless otherwise stated in the
Villa Terms and Conditions. During peak periods (Christmas and New Year), the minimum stay is 4-7 days. For public holidays such as Easter and Chinese New Year, the minimum stay is 5 days. This may not apply in some cases.

WEDDINGS AND EVENTS
All bookings are assumed to be for normal holiday purposes only (no subletting or assignment) and the guest accepts that use of the property is limited to this purpose unless otherwise confirmed in writing. If the guest is planning to hold an event, such as a wedding or party, which involves exceeding the maximum number of guests allowed in each villa, please contact OWNER, at the time of booking, as approval or special arrangements may be required. depending on each villa. Some villas may or may not allow weddings on site.

INSURANCE
It is mandatory for the booking that the Client and/or Guests are covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation cover). OWNER or the owners of the rented properties will not be held liable by the client or traveller and the group for any traveler against any claim, including any accident related to the use of the facilities of the villa or third party services purchased on-site such as, but not limited to, boat rentals, water sports, jeeps or motorcycles. OWNER, shall not be liable for any delay, additional expense or inconvenience caused directly or indirectly by events beyond OWNER's control, such as civil unrest, fire, flood, extreme weather conditions, pandemic outbreak, acts of God, acts of government, etc.

By accepting this contract, assumes that this requirement has been and will be fully complied with. VILLA STAFF, enjoy staff service during your stay at the villa, unless otherwise stated in the villa terms and conditions. by our concierge team prior to arrival and are subject to availability. The Client and/or Guests must allow staff such as pool maintenance workers and gardeners access to the grounds in order to complete their work.

NO PETS ALLOWED
There is a "no pets policy" in the villa and properties surrounding areas.

NO SMOKING IN COMMON AREAS
Smoking is strictly prohibited in the villa. Smoking must be done outside, where an ashtray is provided. If signs of smoking are observed, a cleaning fee of $300 OR EQUIVALENT IN Baths will be applied. Smoking INSIDE THE HOUSE is a breach of the rental agreement and may result in cancellation of the booking, without compensation. 

FOOD AND DRINKS
All food and beverages purchased on behalf of guests are charged at cost plus a 20% surcharge, transportation, time needed for the purchase process as well as use of the kitchen, unless otherwise stated in the villa terms and conditions may apply. Food and beverage bills must be paid periodically and before departure.

SHEETS AND TOWELS
Linen and towels are changed every three (3) days unless otherwise stated in the villa terms and conditions. Additional charges may apply if more frequent changes are required. Items such as bedding, linen or clothing must not be hung where they are visible from another residence or shared property on the estate. Washing of personal clothing by a third party can be arranged at the tenant's expense, the OWNER cannot be held responsible for any loss or damage due to a third party.

PROPER CONDUCT AND CARE
The properties are generally located in quiet residential areas. The client is requested to respect this.
Indoor parking is available for 4 automobiles Also, ensure that all guests and visitors to the property behave appropriately. Illegal or immoral activities, including gambling, prostitution, prohibited drugs, possession or use of fireworks or dangerous goods, and possession or use of firearms and other weapons are all strictly prohibited.

Smoking is generally prohibited unless otherwise stated in the booking confirmation or voucher. The guest is responsible for the behaviour of guests staying at the property, as well as visitors to the property during the rental period. If any guest(s) or visitor(s) fail to behave properly, the OWNER or the OWNER's representative may, at their sole discretion, require the guest, their party and/or visitor(s) to vacate the premises and/or leave the property immediately, without compensation or refund. In the interest of safety, precautions should be taken in the property at any time, especially with children. Proper supervision must be ensured around swimming pools, beaches and roads, and when using the property's facilities.

VALUABLES AND SECURITY
Any valuables or property of the Guest left or used in the Property are at the Guest's own risk.
SAFE IS AVAILABLE IN EACH ROOM, the OWNER nor the OWNER's representative accept any liability for loss or damage to Guests' property. The Guest is responsible for the property during the rental period and must ensure that all windows and doors are securely locked when not on the premises. Any act or omission by the Guest, his/her group and/or visitors which may invalidate or prejudice the property insurance policy and/or result in loss or damage is the responsibility of the Client. The villa varies in terms of standard of luxury, quality and finish, and there are differences in style and decoration. The descriptions of the properties provided by, are made in good faith.

COMPLAINTS
OWNER, accepts no responsibility for any changes made that are not mentioned on the website or elsewhere. OWNER and/or the local representative cannot be held responsible for any failures in water supply, electricity or internet connection, or the pool filtration systems, but will do its best to remedy these problems. to be resolved promptly.

Should any problems arise during the rental period and cannot be resolved by dealing directly with the local villa staff, guests may contact OWNER or their local representative immediately, telephone: +66 91 058 5696 and OWNER will do their best to rectify the situation. It is understood that local infrastructure, standards and conditions are often less developed in a remote resort than in more urban environments. OWNER will do everything reasonably possible to avoid and rectify any problems that may arise, but cannot be held responsible for any problems beyond its control. Any complaints must be notified to OWNER, or their local representative within 24 hours of the event giving rise to the complaint, and must then be notified in writing to OWNER, prior to departure. If a reported problem is not resolved, please lodge a complaint in writing with OWNER, within 14 days of the end of the rental period. If the villa is vacated before the end of the rental period without mutual agreement, this may result in the loss of any right to compensation. No claims will be considered if made after the departure date or if not acknowledged by the villa owner and OWNER, or the local representative.

The Client and/or Guests hereby acknowledge and agree that personal data (e.g. name, age, contact details, credit card information) provided to IV may be collected and used for any of the following purposes:
• Perform any obligation under or in connection with the provisions hereof;
• Verify the identity of the customer and/or guests;
• Respond to, manage and process requests, inquiries, requests, complaints and comments from customers and/or guests;
• Process payment or credit transactions;
• Comply with all applicable laws and regulations or assist in law enforcement and investigations
by any governmental and/or regulatory authority;
• Legitimate and public interests;
• Any other purpose for which the client and/or guests have provided the information to OWNER
The Client and/or Guests agree that OWNER may disclose their personal data for the following purposes:
• Where such disclosure is required to perform obligations under or in connection with the provisions hereof;
• Legitimate and public interests;
Obligations to third party service providers, agents and other organisations as required by applicable laws.
The Client’s and/or Guests’ consent to the collection, use and disclosure of Personal Data
below shall remain valid until withdrawn in writing by the Client and/or Guests, or twelve (12)
months after the termination of these General Conditions. Any request made by the Client and/or the Guests to cease using and/or disclosing Personal Data for all or part of the purposes
listed above must be submitted to IV in writing.

JURISDICTION
Any contract concluded will be concluded upon acceptance by both parties of these conditions 8
general terms and conditions, which are governed by the law of THAILAND and the courts of PATTAYA shall have jurisdiction to hear and determine any claim or dispute arising out of or in connection with them. If any provision of this Rental Agreement is or becomes invalid, or if there is an omission in the general terms and conditions, the other general terms and conditions shall remain valid and enforceable and shall not be challenged.

AGREEMENT
The OWNER reserves the right to change prices, terms and conditions with prior notice. I/we agree that the above terms and conditions have been read, understood and accepted and hereby accept
the application of the above general conditions to our reservation.
